Popup Scheduler - Terms of Service

These Terms of Service explain the rules for merchants using the Popup Scheduler Shopify app and summarize how data is processed when the app is used.

Plain-English summary: Popup Scheduler helps merchants show scheduled storefront popups, optionally collect email signups into Shopify customer records, and manage popup campaign settings stored in Shopify metafields. Merchants control whether the email feature is enabled and are responsible for using it lawfully on their storefronts.

1) Agreement

These Terms apply between Syntax Repairs ("we", "us", or "our") and the merchant that installs or uses Popup Scheduler ("you" or "merchant"). By installing, accessing, or using the App, you agree to these Terms.

2) What the App does

  • Create, style, schedule, and manage popup campaigns for a Shopify storefront.
  • Save popup campaign configuration in Shopify metafields such as pps/campaigns.
  • Check plan status and popup limits using Shopify billing data and a lightweight cached metafield.
  • Optionally collect email signups through storefront popups and write those submissions into Shopify customer records when you enable the feature and approve the required permissions.

3) Merchant responsibilities

  • You are responsible for the content, timing, targeting, and legal compliance of the popups you publish.
  • You are responsible for making any disclosures or obtaining any consents required by applicable law for your storefront visitors.
  • If you enable email capture, you are responsible for ensuring that your signup wording, marketing practices, and customer communications comply with applicable privacy, marketing, and consumer laws.
  • You are responsible for reviewing data written into your Shopify customer records and for handling customer requests relating to that data in your store.

4) Optional email capture feature

Popup Scheduler includes an optional email signup feature on eligible plans. When enabled by you and after you approve the required Shopify permission, submitted email addresses may be written into your Shopify customer records. The App may also:

  • update email marketing consent in Shopify based on the visitor's form submission,
  • apply standard tags such as popup-scheduler,
  • apply popup attribution tags based on the popup or campaign, and
  • apply any additional customer tags that you configure in the popup editor.

You control whether this feature is used. Existing merchants are not forced to grant the optional permission, and the feature should only be used where you have a valid basis to collect and use the submitted email addresses.

5) Data processing summary

For merchant-facing app data and storefront interactions processed by the App, we generally act as a service provider / processor to help you operate the App. This includes processing popup settings, app session data, limited technical request data, and optional email signup submissions that are sent into your Shopify store.

  • Merchant data: shop metadata, app settings, popup campaigns, plan gating information, and app authentication/session data.
  • Storefront technical data: functional popup cookies and standard server logs used for security, performance, and troubleshooting.
  • Optional customer signup data: submitted email addresses and related popup/tag context, written into your Shopify customer records on your behalf.

6) Minimum necessary use

We aim to process only the minimum personal data reasonably required to provide the App's functionality. We do not sell personal information, and we do not use customer signup data for our own independent marketing campaigns.

7) Shopify permissions and platform rules

  • The App relies on Shopify-granted scopes and permissions.
  • Some features are unavailable unless you approve the relevant Shopify access scope.
  • If Shopify changes its platform rules, API behavior, or protected customer data requirements, we may update the App and these Terms to remain compliant.

8) Availability and changes

We may improve, modify, suspend, or discontinue parts of the App from time to time. We try to avoid breaking core functionality for active merchants, but Shopify platform changes, third-party outages, or infrastructure issues may affect availability.

9) Acceptable use

You must not use the App to:

  • collect data unlawfully or in a misleading way,
  • send unlawful marketing or spam,
  • misrepresent discount offers or deceptive popup content,
  • attempt to interfere with the security or stability of the App or Shopify platform.

10) Security

We use reasonable technical and organizational safeguards to protect App-related data, including HTTPS in transit, scoped Shopify permissions, least-privilege practices, and session/token security appropriate to the App's design.

11) Termination

These Terms continue while you use the App. They end when you uninstall the App or stop using it, except for provisions that reasonably need to survive, such as payment obligations, liability limits, and compliance-related provisions.

12) Limitation of liability

To the maximum extent permitted by law, the App is provided on an "as available" basis. We are not liable for indirect, incidental, special, or consequential losses, including lost profits, lost sales, or business interruption arising from use of the App. Our total liability relating to the App is limited to the amount you paid for the App in the 12 months before the event giving rise to the claim, if any.

13) Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date and may also provide notice in the App or through the app listing where appropriate.
